Suva Magistrate Seini Puamau will make her ruling on the No Case to Answer application by former Fiji Prime Minister Voreqe Bainimarama and suspended Police Commissioner Sitiveni Qiliho on Thursday.
The ruling had been scheduled to be delivered today, but Puamau informed the court that the ruling was not ready.
She will decide on the matter at 3pm Thursday.
Bainimarama is charged with one count of attempting to pervert the course of justice, and Qiliho, charged with a count of abuse of office.
They are accused of obstructing a police investigation into a complaint lodged by the University of the South Pacific in July 2019 regarding the activities of former university staff members.
