Former Deputy Prime Minister Manoa Kamikamica appeared in the High Court in Suva this morning.
Defense lawyer, Wylie Clarke, asked the court to stop the criminal case against him, arguing that the appointment of Acting FICAC Commissioner Lavi Rokoika was not valid because it was made without the Judicial Services Commission and therefore anything done under her authority should be treated as unlawful.
He also suggested that Kamikamica’s case be heard together with Professor Biman Prasad’s matter since both raise the same constitutional issue, and that a King’s Counsel will handle the proceedings on their behalf.
Clarke informed the judge that they will be filing for a Memorandum this Friday before the case is called again for mention on Wednesday next week.
Kamikamica is facing one count of perjury and one count of giving false information to a public servant, linked to statements he allegedly made during the Commission of Inquiry into the appointment of former FICAC Commissioner Barbara Malimali.
